1. Overview
TESCO - The Eastern Specialty Company ("TESCO," "we," "us," or "our") operates Adaptiv™. This Privacy Policy describes what personal information we collect, how we use it, and your options with respect to that information. It applies to all users of Adaptiv and any associated services, including SMS messaging notifications.

2. Information We Collect
2.1 Information You Provide
We collect the following information you submit directly when using the Service:
- Name — used to create and identify your account
- Email address — used for account communication and notifications
- Phone number — collected if you configure SMS or push notifications
- Mailing address — collected during account registration or billing setup
- Organization name and role — used to associate your account with your utility or municipality
- Any content, data, or files you upload or enter within the Service
2.2 Information Collected Automatically
When you use the Service, we may automatically collect the following technical data:
- IP address — used for security monitoring and access logging
- Browser type, version, and language settings
- Device type, operating system, and screen resolution
- Pages visited, session duration, and in-Service actions
- Request timestamps and error reports
2.3 Information from Third Parties
If you authenticate using a third-party identity provider such as Google or Microsoft, we receive the basic profile information that provider shares in accordance with your settings there — typically your name and email address.
3. How We Use Your Information
We use the information we collect for the following purposes:
- Delivering and operating the Service, including account management and feature fulfillment
- Sending operational notifications and alerts you have configured within the Service, including SMS messages
- Providing technical support and resolving issues
- Analyzing usage patterns to improve Service functionality and reliability
- Detecting and responding to security incidents, fraud, and abuse
- Meeting legal and contractual obligations
We do not sell your personal information and do not use it for advertising.
4. SMS Messaging and Consent
4.1 SMS Notifications
Adaptiv may send operational SMS notifications to phone numbers you provide and configure within the Service. These messages include alarm alerts, dispatch notifications, and other operational events relevant to your utility operations. Message frequency varies based on your configured alert rules and operational activity.
Message and data rates may apply. You are responsible for any carrier charges associated with receiving SMS messages.
4.2 Opt-In Consent
By providing your phone number and enabling SMS notifications within the Service, you consent to receive operational SMS messages from Adaptiv. Your consent to receive SMS messages is not a condition of using the Service.
4.3 Opt-Out Instructions
To stop receiving SMS messages at any time, reply STOP to any message. You will receive a confirmation that you have been unsubscribed. To re-enable notifications, log in to the Service and update your notification settings. For help, reply HELP to any message or contact us at privacy@tescometering.com.
4.4 SMS Consent Data
All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Mobile opt-in consent and phone numbers collected for SMS notifications will not be shared with third parties or affiliates for marketing or promotional purposes.
Carriers are not liable for any delayed or undelivered messages.
5. Disclosure of Information
We share your information only in the following circumstances:
- Service providers: Third-party vendors who process data on our behalf under contractual data protection obligations, limited to the purposes for which they were engaged
- SMS delivery: Phone numbers and message content are transmitted to our SMS provider (Twilio, Inc.) solely for the purpose of delivering notifications you have configured. Twilio processes this data under a Data Processing Agreement and may not use it for any other purpose
- Legal compliance: When required by law, regulation, court order, or government authority, or when necessary to protect the rights, property, or safety of users or the public
- Business transfers: In connection with a merger, acquisition, or sale of assets. We will provide advance notice, and your continued use of the Service will be subject to the successor's privacy terms
- With your consent: For any other disclosure you have expressly authorized
We do not sell, rent, or trade your personal information or SMS opt-in data to any third party.
6. Data Retention
We retain your information for as long as your account is active and for a reasonable period afterward to fulfill outstanding obligations, resolve disputes, or comply with legal requirements:
- Account and contact information: retained for the life of the account plus 90 days following closure
- Usage and log data: up to 12 months
- Notification delivery records: up to 24 months for audit and troubleshooting purposes
- SMS opt-in consent records: retained for the duration of the account and for 5 years following opt-out or account closure, as required for compliance purposes
On account closure, we delete or anonymize personal information within 90 days unless retention is required by law.
7. Security
We apply administrative, technical, and physical controls appropriate to the sensitivity of the data we process, including:
- TLS 1.2 or higher for all data in transit
- Role-based access control with least-privilege enforcement
- Patch and vulnerability management with periodic security assessments
- An incident response program with defined detection, containment, and notification procedures
If a breach affects your personal information, we will notify you as required by applicable law. If you believe your account has been compromised, contact us immediately.
8. Access and Control
You may request access to, correction of, or deletion of the personal information we hold about you, or a portable copy of your data. Submit requests to the contact address in Section 11. We will respond within 30 calendar days and may require identity verification before acting.
Non-essential notifications, including SMS, can be disabled at any time through your account settings without affecting access to the Service.
9. Cookies
The Service uses session cookies necessary for authentication and function. We also may collect aggregate analytics through cookies to understand feature usage; these can be disabled in your browser settings without affecting core functionality. We do not use advertising cookies or cross-site tracking.
10. Children
The Service is not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have done so, contact us and we will delete it promptly.

12. Changes to This Policy
We may revise this Privacy Policy as our practices or legal obligations change. Material changes will be communicated by updating the Effective Date and providing at least 30 days' advance notice via email or an in-Service notice. Continued use of the Service after a revision takes effect constitutes acceptance of the updated policy.
13. Governing Law
This Privacy Policy is governed by the laws of the State of Pennsylvania. Disputes arising under this policy will be resolved in the courts of Pennsylvania.
